These Terms & Conditions apply to purchases made through That’s The Spot Surprise.

By placing an order, you agree to these Terms & Conditions.

2. Adults Only

That’s The Spot Surprise products are intended for adults aged 18 years and over.

By purchasing from us, you confirm that you are at least 18 years old and legally able to purchase adult products in your location.

3. Our Products

That’s The Spot Surprise is an adults-only blind box product.

Each box contains one surprise beginner-friendly pleasure product. Because the product is selected at random, customers cannot choose which item they receive.

We make every effort to describe our products accurately, however product colours, packaging, inclusions, and availability may vary slightly.

4. Orders & Payment

When you place an order, you are making an offer to purchase the selected product/s.

Your order is accepted once payment has been received and your order confirmation has been issued.

All prices are listed in Australian dollars and include GST where applicable.

We reserve the right to cancel or refuse an order if there is an error, stock issue, suspected fraud, or another reasonable concern. If your order is cancelled after payment has been made, you will receive a refund.

5. Shipping & Delivery

We currently ship within Australia.

Orders are shipped to the delivery address provided at checkout. Please ensure your details are correct before placing your order.

Delivery timeframes are estimates only and may vary depending on Australia Post, courier delays, public holidays, busy periods, or circumstances outside our control.

Once your order has been dispatched, risk in the goods passes to you.

6. Discreet Packaging

We understand privacy is important.

Orders are shipped in discreet packaging wherever possible. However, delivery labels may include required sender, shipping, or courier information.

7. Returns, Refunds & Faulty Items

Due to the personal nature of our products and the surprise format of the blind box, we do not offer refunds, returns, exchanges, or credits for change of mind, including if you receive a product that is not your preferred style.

This does not affect your rights under the Australian Consumer Law.

If your product is faulty, damaged, or incorrect, please contact us at hello@thatsthespot.com.au with:

• Your full name
• Order number
• Proof of purchase
• A clear photo or video showing the issue
• A brief description of the fault or concern

If your claim is approved, we may offer a replacement, refund, or other remedy in accordance with Australian Consumer Law.

We may request further photos, videos, or troubleshooting before approving a claim.

Fault claims caused by misuse, accidental damage, user error, improper charging, or normal wear and tear may not be eligible for replacement or refund.

8. Gift Purchases

If you received a That’s The Spot Surprise product as a gift, the original purchaser may need to provide proof of purchase before a refund, replacement, or warranty claim can be processed.

Refunds will be issued to the original payment method where applicable.

9. Promotions & Discount Codes

From time to time, we may offer promotions, giveaways, discount codes, or free gifts with purchase.

Unless stated otherwise:

• Discount codes cannot be combined with other offers
• Discount codes are not redeemable for cash
• Promotions are available for the stated period or while stocks last
• Free gifts are selected at our discretion and cannot be exchanged or refunded
• We may change, pause, or withdraw promotions at any time

10. Gift Cards

Gift cards are subject to Australian Consumer Law and any terms displayed at the point of purchase.

Unless otherwise stated, gift cards are valid for at least three years from the date of issue.

Gift cards are not redeemable for cash, except where required by law.

Lost, stolen, or damaged gift cards may not be replaced unless required by law.

11. Intellectual Property

All content on our website, including text, images, graphics, product names, branding, logos, packaging designs, and other materials, is owned by or licensed to That’s The Spot Pty Ltd.

You must not copy, reproduce, distribute, or use our intellectual property without written permission.

You agree not to misuse our website, interfere with its operation, attempt unauthorised access, or use the website for unlawful purposes.

We may update, suspend, or remove website content at any time.

14. Limitation of Liability

To the extent permitted by law, That’s The Spot Pty Ltd is not liable for indirect, incidental, or consequential loss arising from the use of our website, products, or services.

Nothing in these Terms limits your rights under the Australian Consumer Law.
